1. About InfluDM and These Terms

InfluDM is a social media automation platform operated by Binjaratech IT Solutions Private Limited, a company incorporated in India (hereinafter referred to as "the Company", "we", "us", or "our"), with its registered office at E, NetGuru Building, 2/4, GP Block, Sector V, Bidhannagar, Kolkata, West Bengal – 700091, India.

By accessing or using the InfluDM web application, website, API, or any related services (collectively, the "Service"), you ("User", "you") agree to be bound by these Terms & Conditions ("Terms"). If you do not agree, please do not use the Service.

These Terms apply to all users of the Service, including visitors, registered users, and businesses that connect their social media accounts.

2. Description of Service

InfluDM enables Instagram Business and Creator account holders to:

  • Build automated response flows triggered by Instagram comments, direct messages, story replies, and live chat messages;
  • Configure keyword-based triggers and automated replies including text messages, card messages with buttons, and public comment replies;
  • Manage and view contact records of Instagram users who interact with their flows;
  • Monitor flow execution logs and basic engagement metrics.

The Service acts as an authorised intermediary between you and the Meta / Instagram platform using Meta's official Graph API and Webhooks.

3. Account Registration & Eligibility

To use InfluDM you must:

  • Be at least 18 years of age;
  • Provide a valid email address and create a secure password;
  • Own or have authorised management access to an Instagram Business or Creator account;
  • Comply with Meta's Terms of Service, Instagram's Community Guidelines, and all applicable laws.

You are solely responsible for maintaining the confidentiality of your account credentials. You must notify us immediately at info@binjaratech.com if you suspect unauthorised access to your account.

4. Permitted Use & Restrictions

You agree to use InfluDM only for lawful purposes and in compliance with these Terms. Specifically, you agree not to:

  • Use the Service to send spam, unsolicited bulk messages, or harass any individual;
  • Automate interactions in a manner that violates Meta's Platform Terms, Instagram's Community Guidelines, or any applicable anti-spam laws (including India's IT Act, 2000 and the Telecom Commercial Communications Customer Preference Regulations);
  • Scrape, harvest, or collect data from Instagram users beyond what is necessary for the Service's core functionality;
  • Use the Service to impersonate any person or entity;
  • Reverse-engineer, decompile, or attempt to extract the source code of the Service;
  • Resell, sublicense, or commercially exploit the Service without the Company's written consent;
  • Upload or transmit malware, viruses, or any harmful content through the Service;
  • Attempt to circumvent any security measures or rate limits imposed by the Service or by Meta.

We reserve the right to suspend or terminate your account if we determine, in our sole discretion, that you have violated these restrictions.

5. Instagram & Meta Platform Compliance

InfluDM is built on Meta's official Instagram API with Instagram Login. By connecting your Instagram account, you acknowledge and agree that:

  • You must at all times comply with Meta's Platform Terms and Instagram's Community Guidelines;
  • InfluDM is an independent product and is not affiliated with, endorsed by, or sponsored by Meta Platforms, Inc. or Instagram;
  • We access your Instagram data (including messages, comments, and profile information) solely as permitted by your Instagram account permissions and solely for the purpose of providing the Service to you;
  • You are responsible for ensuring that the automated messages sent through InfluDM do not violate Meta's Messaging Policy, spam policies, or any applicable consumer protection laws;
  • Meta may at any time change its API terms, which may affect the functionality of InfluDM. We will endeavour to update the Service accordingly but cannot guarantee uninterrupted operation;
  • Your authorisation for InfluDM to access your Instagram account can be revoked at any time through the InfluDM Settings page or via your Instagram connected apps settings.

6. Data & Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy describes in detail what data we collect, how we use it, and your rights in relation to that data.

In summary:

  • We store your Instagram access tokens securely (encrypted at rest) to perform API calls on your behalf.
  • We process Instagram user data (such as commenter IDs and message text) only to the extent necessary to deliver and improve the Service.
  • We do not sell your data or your Instagram contacts' data to third parties.
  • You may request deletion of all your data by deleting your InfluDM account via Settings.

7. Intellectual Property

All intellectual property rights in the InfluDM platform, including software, design, trademarks, and content, are owned by or licensed to Binjaratech IT Solutions Private Limited. These Terms do not grant you any ownership rights in the Service.

You retain full ownership of your content (flow configurations, messages, and data) that you create through the Service. By using the Service you grant us a limited, non-exclusive, royalty-free licence to process your content solely for the purpose of delivering the Service.

8. Free Plan Limitations

The free tier of InfluDM is subject to the following limits, which may be revised from time to time:

  • 1,000 automated messages per calendar month
  • 1,000 contact records
  • 1 connected Instagram account

Exceeding these limits may result in temporary suspension of automation features until the start of the next billing period.

9. Disclaimers & Limitation of Liability

The Service is provided on an "as is" and "as available" basis without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the fullest extent permitted by applicable law, Binjaratech IT Solutions Private Limited shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages;
  • Loss of profits, revenue, data, business opportunities, or goodwill;
  • Service interruptions caused by Meta API changes, downtime, or policy updates;
  • Actions taken by Instagram or Meta in respect of your account, including suspension or restriction of your Instagram account due to automated activity.

Our total aggregate liability to you for any claim arising out of or relating to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim (or INR 1,000 if no payment was made).

10. Indemnification

You agree to indemnify, defend, and hold harmless Binjaratech IT Solutions Private Limited and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of:

  • Your use of or access to the Service;
  • Your violation of these Terms;
  • Your violation of any third-party rights, including Meta's Platform Terms or any Instagram user's privacy rights;
  • Any content you transmit through the Service.

11. Termination

You may stop using the Service and delete your account at any time via the Settings page. Upon account deletion, all your data (including flow configurations, contacts, and execution logs) is permanently erased from our systems within 30 days.

We may suspend or terminate your access to the Service immediately, without prior notice, if:

  • You breach any provision of these Terms;
  • We are required to do so by Meta or by applicable law;
  • Continued provision of the Service would pose a legal or reputational risk to the Company.

Upon termination, all licences granted to you under these Terms will immediately cease.

12. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be subject to the exclusive jurisdiction of the courts at Kolkata, West Bengal, India.

13. Changes to These Terms

We reserve the right to update these Terms at any time. When we do, we will revise the "Last updated" date at the top of this page. For material changes, we will notify registered users by email or through an in-app notice at least 7 days before the changes take effect.

Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.

In accordance with the Information Technology Act, 2000, and the rules made thereunder, the name and contact details of the Grievance Officer are the same as above. We will endeavour to acknowledge and resolve your grievance within 30 days of receipt.
